These Terms of Service (“Terms”) govern your access to and use of originsculpture.com (the “Site”), including your purchase of products, submission of custom project inquiries, and use of any related services provided by Origin Sculpture (“Origin Sculpture,” “we,” “us,” or “our”).

Please read these Terms carefully before using the Site or placing an order.

By accessing the Site, submitting an inquiry, approving a quotation or design, creating an account, or placing an order, you agree to these Terms and any policies incorporated into them. If you do not agree, you should not use the Site or purchase our products.

Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded or limited.

1. About Origin Sculpture

Origin Sculpture provides handcrafted and custom-fabricated sculptures for private residences, gardens, hotels, commercial properties, architectural spaces, and public environments.

Our products may include bronze, stainless steel, marble, natural stone, fiberglass, mixed-media sculpture, fountains, bases, pedestals, and related components.

Our Site is hosted using Shopify, which provides the ecommerce platform through which certain products and services are offered.

2. Eligibility and Website Use

You must be legally capable of entering into a binding contract in your jurisdiction to place an order through the Site.

You agree to use the Site only for lawful purposes and not to:

  • Violate any applicable law or regulation;

  • Infringe the intellectual property or privacy rights of another party;

  • Submit false, misleading, fraudulent, or unauthorized information;

  • Introduce viruses, malicious code, or other harmful technology;

  • Attempt to gain unauthorized access to the Site or its systems;

  • Scrape, copy, reproduce, or commercially exploit Site content without permission;

  • Interfere with the security or operation of the Site; or

  • Use the Site in a way that could harm Origin Sculpture, its customers, or another person.

We may restrict or suspend access to the Site when reasonably necessary to protect our business, customers, systems, or legal rights.

3. Product Information

We make reasonable efforts to present product descriptions, dimensions, finishes, colors, materials, and images accurately.

However, photographs and digital displays may be affected by lighting, camera settings, screen calibration, surrounding environments, and image processing. Product images, samples, renderings, and visual references should therefore be understood as representative rather than exact guarantees of color or appearance.

Unless expressly stated otherwise:

  • Dimensions are approximate;

  • Product prices apply only to the configuration and options shown or selected;

  • Custom sizes, finishes, engineering, bases, pedestals, fountains, installation systems, or site-specific requirements may involve additional charges;

  • Decorative surroundings, landscaping, architectural elements, and display accessories shown in images are not included; and

  • Installation services are not included in the listed product price.

Custom bases and pedestals are available upon request. Their cost is excluded from the listed product price unless the base is expressly included in the product description, images, selected options, or written quotation.

4. Orders and Contract Formation

Submitting an order does not automatically mean that we have accepted it.

After receiving an order, we may review:

  • Product availability;

  • Selected size, material, finish, and base;

  • Production feasibility;

  • Delivery location and access conditions;

  • Pricing accuracy;

  • Payment authorization;

  • Custom requirements; and

  • Legal or shipping restrictions.

A binding sales contract is formed when Origin Sculpture accepts the order through an order confirmation, approved quotation, invoice, or other written confirmation.

An automated order-receipt email only confirms that we received the order and does not necessarily constitute final acceptance.

We reserve the right to decline or cancel an order before production begins where reasonably necessary, including because of:

  • An incorrect price or product description;

  • Payment or fraud concerns;

  • Production or material limitations;

  • Safety, engineering, or installation concerns;

  • Shipping restrictions;

  • Incomplete or inconsistent project information; or

  • A design that cannot reasonably be manufactured.

If we cancel an accepted order for reasons not caused by the customer and before production begins, amounts paid for the cancelled product will be refunded as required by applicable law.

5. Quotations and Project-Based Pricing

Certain sculptures and custom projects are priced through an individual quotation.

Unless the quotation states otherwise:

  • A quotation is valid only for the period shown;

  • Pricing is based on the dimensions, materials, finish, design, delivery information, and scope available when the quotation is issued;

  • Changes to the specifications may change the final price;

  • Shipping, installation, engineering, taxes, duties, bases, pedestals, lighting, plumbing, foundations, or lifting equipment are included only when specifically stated; and

  • A quotation does not reserve production capacity until the required payment is received and the order is accepted.

Obvious typographical, calculation, or system errors do not require us to supply a product at an incorrect price. If an error is discovered after an order is submitted, we will contact you with the corrected information and provide the choices required by applicable law.

6. Custom and Made-to-Order Products

Most Origin Sculpture products are handcrafted, made to order, configured to customer selections, or produced for a specific project.

A custom or made-to-order product may include:

  • A custom size or proportion;

  • A selected or custom finish;

  • A custom base or pedestal;

  • A personalized inscription or design;

  • A modified existing design;

  • A portrait or site-specific artwork;

  • Custom structural, anchoring, plumbing, or installation requirements; or

  • Any product manufactured specifically for the customer after the order is placed.

You are responsible for providing accurate dimensions, reference files, installation information, access conditions, and other project requirements.

Origin Sculpture is not responsible for errors caused by inaccurate, incomplete, or misleading information supplied by the customer or the customer’s representatives.

7. Design Development and Approval

Where design approval is required, we may provide drawings, renderings, finish references, measurements, or specification documents for review.

Production will begin only after:

  • The required payment has been received;

  • The relevant design and specifications have been approved;

  • Required customer information has been provided; and

  • Any other stated production conditions have been satisfied.

By approving a drawing, rendering, color sample, finish reference, dimension, or specification, you confirm that you have reviewed and accepted the applicable:

  • Design and composition;

  • Dimensions and proportions;

  • Material and finish;

  • Color direction;

  • Base or pedestal;

  • Text, spelling, or inscription;

  • Installation or anchoring details; and

  • Other displayed specifications.

Approval may be provided by email, electronic confirmation, signed document, customer portal, or another recorded method.

8. Changes After Approval

Requests made after design approval may affect the price and production schedule.

Post-approval changes may require:

  • Revised drawings or renderings;

  • New molds, models, materials, or engineering;

  • Modification or replacement of work already completed;

  • Additional labor;

  • A revised production schedule; and

  • Additional payment.

We will provide the revised cost or scope for approval where reasonably practical. Work on the affected portion may be paused until the revised details and payment requirements are confirmed.

Origin Sculpture is not required to implement a requested change if production has advanced to a stage where the change is unsafe, impractical, or would compromise the artwork.

9. Handcrafted Artwork and Natural Variations

Every Origin Sculpture artwork is individually handcrafted or custom-fabricated. Minor differences are an inherent part of the artistic and production process.

Variations may occur in:

  • Color and tonal balance;

  • Patina and oxidation;

  • Casting and surface texture;

  • Weld finishing or polishing;

  • Stone veining, mineral distribution, pores, and natural fissures;

  • Dimensions and symmetry;

  • Hand-finished details; and

  • The relationship between the finished sculpture and photographs, renderings, or samples.

Bronze patina, including gradual darkening, oxidation, or the development of green tones, is a natural material response and is not considered a defect.

Natural stone may contain variations in tone, veining, texture, mineral deposits, pores, and fissures. These are natural characteristics rather than manufacturing defects unless they materially affect structural integrity.

Minor handcrafted and natural material variations do not constitute defects or grounds for rejection, return, refund, or chargeback, except where applicable law provides otherwise.

10. Payments

You agree to provide current, complete, and accurate payment and billing information.

Payment requirements may vary depending on the product or project and may include:

  • Full payment when the order is placed;

  • A deposit followed by one or more progress payments; or

  • A payment schedule stated in a quotation, invoice, or project agreement.

Production may be paused if a required payment is overdue. Any resulting schedule change will not be treated as a production delay caused by Origin Sculpture.

You are responsible for payment-processing fees, bank fees, currency-conversion charges, taxes, or other charges where these are not expressly included in the order total or where applicable law permits.

Payment through a third-party provider is also subject to that provider’s terms and privacy practices.

11. Cancellations, Returns, and Refunds

Cancellation and return eligibility depends on the nature of the product, the production stage, and applicable law.

Custom, personalized, modified, and made-to-order products may not be eligible for cancellation or return after production has begun because they are manufactured specifically for the customer.

If a cancellation is permitted, deductions may apply for:

  • Design or engineering work already completed;

  • Custom models, molds, or samples;

  • Materials purchased or allocated;

  • Production work completed;

  • Payment-processing costs where legally permitted;

  • Packaging, storage, or transportation expenses; and

  • Other non-recoverable project costs.

Any applicable terms are explained in our Refund and Cancellation Policy and in project-specific quotations or agreements.

Nothing in this section limits cancellation, refund, or withdrawal rights that cannot legally be excluded. In some jurisdictions, statutory withdrawal rights may not apply to goods made to the customer’s specifications or clearly personalized.

12. Production Schedule

Unless otherwise confirmed in writing, the estimated production and delivery period is generally 9–12 weeks after final drawing approval.

The estimated timeline may be affected by:

  • Product size and complexity;

  • Material availability;

  • Casting, carving, welding, polishing, or finishing requirements;

  • Customer-requested changes;

  • Delayed approvals or payments;

  • Weather-sensitive finishing processes;

  • Order volume;

  • Customs processing; and

  • Freight or delivery conditions.

Production and delivery dates are estimates unless expressly identified in writing as guaranteed.

If an order cannot be shipped within the timeframe promised at the time of purchase, we will provide notice and the options required by applicable law.

13. Shipping and Delivery

Shipping availability, costs, included services, international duties, restricted locations, receiving requirements, and delivery procedures are governed by our Shipping & Delivery Policy and any written quotation.

Delivery may be curbside unless otherwise expressly stated. Customers may be responsible for arranging:

  • Unloading personnel;

  • Forklifts, cranes, or lifting equipment;

  • Safe site access;

  • Indoor or final-position delivery;

  • Installation;

  • Foundation preparation; and

  • Removal or disposal of packaging.

You must provide accurate delivery information and disclose access limitations, including narrow roads, gated entrances, steep driveways, restricted loading areas, or equipment limitations.

Additional costs caused by incorrect delivery information, failed appointments, restricted access, storage, redelivery, or customer-requested changes may be charged to the customer where legally permitted.

14. Inspection and Shipping Damage

You or your authorized representative should inspect the shipment and external packaging at delivery.

Visible damage should be noted on the carrier’s delivery receipt before signing. Photographs of the packaging, crate, sculpture, and affected area should be taken before the product is moved or installed.

Shipping damage must be reported within the period stated in our Shipping & Delivery Policy. You must preserve the packaging and cooperate with reasonable carrier or insurance documentation requirements.

Nothing in this section limits rights available under applicable consumer law.

15. Risk of Loss and Title

Risk of loss and title will transfer according to:

  • Applicable law;

  • The agreed delivery terms;

  • Any Incoterms stated in the quotation or invoice; and

  • The applicable shipping arrangement.

Nothing in these Terms transfers risk to a consumer earlier than permitted by applicable law.

Ownership of a product may remain with Origin Sculpture until all amounts due for that product have been paid, where permitted by law.

16. Installation and Site Conditions

Unless installation is expressly included in writing, the customer is responsible for arranging qualified installation.

The customer and relevant project professionals are responsible for confirming:

  • Foundation capacity;

  • Structural support;

  • Anchoring requirements;

  • Local building codes and permits;

  • Utility locations;

  • Electrical and plumbing requirements;

  • Drainage and freeze protection;

  • Wind, seismic, and environmental conditions;

  • Public-access and safety requirements; and

  • Suitability of the selected installation location.

Origin Sculpture is not responsible for damage caused by improper installation, unsuitable foundations, inadequate drainage, unauthorized modifications, or failure to follow the approved specifications.

Site-specific engineering, stamped drawings, permits, and professional installation are included only when expressly stated in writing.

17. Care and Maintenance

The customer is responsible for reasonable cleaning, inspection, maintenance, drainage, winterization, and environmental care appropriate to the sculpture’s material and location.

Environmental aging, oxidation, natural patina development, stone weathering, and other expected material changes are not defects. Warranty coverage is governed by our Limited Warranty Policy.

18. Customer-Supplied Designs and Materials

If you provide photographs, drawings, logos, portraits, trademarks, text, artwork, designs, or other materials, you represent that:

  • You own the materials or have permission to use them;

  • Our use of the materials for your project will not violate another party’s rights;

  • The materials do not contain unlawful or harmful content; and

  • The information supplied is accurate and suitable for the requested work.

You grant Origin Sculpture a limited license to use, reproduce, adapt, and share those materials only as reasonably necessary to evaluate, design, produce, deliver, install, or support your project.

You are responsible for claims resulting from customer-supplied materials that infringe third-party rights, except to the extent caused by Origin Sculpture’s independent actions.

We will not publicly identify a private customer or project using confidential customer-supplied information without permission, except where the information is already lawfully public or disclosure is required by law.

19. Origin Sculpture Intellectual Property

Unless otherwise agreed in writing, the Site and its content—including text, images, graphics, logos, product photographs, drawings, renderings, layouts, videos, design concepts, and other materials—are owned by or licensed to Origin Sculpture.

You may view and use Site content only for personal evaluation and purchasing purposes.

You may not, without prior written permission:

  • Reproduce or commercially distribute Site content;

  • Copy sculpture designs for production by another supplier;

  • Remove copyright, trademark, or ownership notices;

  • Use our images or renderings to market another product;

  • Create unauthorized derivative commercial works; or

  • Use automated systems to collect substantial portions of Site content.

Purchasing a sculpture does not transfer copyright, design rights, trademarks, production files, molds, models, drawings, or other intellectual property unless expressly agreed in writing.

20. Reviews and Other User Content

If you submit a review, photograph, comment, testimonial, or other content, you represent that the content is accurate, lawful, and does not infringe third-party rights.

You grant Origin Sculpture a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and distribute content that you intentionally submit for publication, subject to our Privacy Policy and applicable law.

We may remove content that is unlawful, misleading, abusive, infringing, unrelated, or contains private information. We will not suppress or remove an honest review solely because it expresses a negative opinion.

21. Third-Party Services and Links

The Site may use or link to third-party services, including payment processors, shipping providers, social platforms, analytics tools, or external websites.

We do not control and are not responsible for third-party content, availability, security, terms, or privacy practices. Your use of third-party services may be governed by separate terms.

22. Disclaimer of Website Information

We make reasonable efforts to maintain accurate Site content, but the Site may occasionally contain incomplete, outdated, or incorrect information.

General articles, guides, and product recommendations are provided for informational purposes and do not replace site-specific advice from architects, structural engineers, installers, conservators, electricians, plumbers, or other qualified professionals.

Products remain covered by any applicable express warranty, statutory guarantee, and non-waivable consumer rights. Nothing in this section disclaims a warranty or obligation that cannot legally be excluded.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Origin Sculpture will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the Site, Services, or products.

Where permitted by law, Origin Sculpture’s aggregate liability arising from an order will not exceed the amount paid to Origin Sculpture for the product giving rise to the claim.

These limitations do not apply to:

  • Fraud or fraudulent misrepresentation;

  • Willful misconduct or gross negligence where liability cannot be limited;

  • Death or personal injury caused by negligence where liability cannot be limited;

  • Breach of non-waivable statutory rights; or

  • Any other liability that cannot legally be excluded or limited.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify Origin Sculpture against third-party claims arising from:

  • Your unlawful use of the Site;

  • Materials or designs supplied by you that infringe third-party rights;

  • Your unauthorized modification or resale of a product; or

  • Your material violation of these Terms.

This section does not require a consumer to indemnify Origin Sculpture for losses caused by Origin Sculpture’s own breach, negligence, or unlawful conduct.

25. Force Majeure

Origin Sculpture will not be responsible for delay or failure caused by events beyond our reasonable control, including:

  • Natural disasters and severe weather;

  • Fire, flood, earthquake, epidemic, or public emergency;

  • War, terrorism, civil unrest, or government action;

  • Port closures, customs disruption, carrier interruption, or transportation restrictions;

  • Labor disputes;

  • Utility, communications, or technology failures;

  • Material shortages or supply-chain disruption; and

  • Export, import, or trade restrictions.

Affected obligations and schedules may be reasonably extended for the duration and effect of the event.

If performance becomes materially delayed or impossible, we will communicate with the customer and provide the remedies required by applicable law.

26. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By submitting project or order information, you confirm that you are authorized to provide any personal information relating to another person, such as a recipient, architect, designer, contractor, or project representative.

27. Suspension and Termination

We may suspend or terminate access to the Site if you materially violate these Terms, engage in fraud or unlawful conduct, threaten the security of the Site, or misuse our intellectual property.

Termination of Site access does not affect payment obligations, accepted orders, intellectual-property rights, liability provisions, or other terms intended to survive termination.

28. Governing Law

The legal entity responsible for your purchase and the applicable jurisdiction may be identified in the relevant quotation, order confirmation, invoice, payment page, or billing statement.

These Terms and each purchase will be governed by the laws applicable to the contracting entity identified in those documents, without regard to conflict-of-law principles.

The parties will first attempt to resolve any dispute through good-faith communication. Nothing in these Terms limits or excludes any mandatory consumer protection rights available under the laws of the customer’s state, country, or habitual place of residence.

29. General Provisions

Entire Agreement

These Terms, together with the accepted quotation, order confirmation, invoice, approved drawings, and incorporated policies, form the agreement between you and Origin Sculpture concerning the relevant order.

If a project-specific written agreement conflicts with these Terms, the project-specific agreement will control for that project.

Severability

If any provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

No Waiver

A delay or failure to enforce a provision does not waive the right to enforce it later.

Assignment

You may not transfer your contractual rights or obligations without our written consent, except where applicable law permits. We may transfer our rights and obligations as part of a merger, restructuring, financing, or sale of business, subject to applicable law.

Headings

Section headings are provided for convenience and do not affect interpretation.

30. Changes to These Terms

We may revise these Terms to reflect changes in our Services, business practices, or legal obligations.

The revised Terms will be posted on this page with an updated “Last Updated” date. Changes will apply prospectively unless otherwise required by law.

The version in effect when an order is accepted will generally govern that order unless both parties agree otherwise or a legal requirement applies.
